Contest Rules

These Rules & Regulations (the "Rules") govern the contest (the "Contest") running on www.mysweetbaby.ca/50years  and www.mysweetbaby.ca/50ans  (the "Site"). No purchase is necessary to enter into the Contest. The act of entering the Contest constitutes acceptance of the Rules and decision(s) of Sweetspot.ca Inc. (“Sweetspot”) and Johnson & Johnson Inc. (the “Sponsor”).

CONTEST
The Contest commences at 12:00 a.m. Eastern Daylight Time on Saturday August 1, 2009 and closes at 11:59 p.m. Eastern Standard Time (“EST”) (the "Closing Time") on Sunday February 28, 2010 (the "Contest Period"). In this Contest, there is a total of one (1) prize: the winner of the Contest (the “Winner”) will be eligible to receive one (1) VIP Mommy  & Baby Photo Shoot Experience  with a professional photographer, with an approximate prize value of $5,000 (CDN) (the "Prize") (see below for Prize details).

ELIGIBILITY
This Contest is open to residents of Canada who are at least the age of majority in their province or territory of residence at the first day of the Contest Period, excluding employees, officers and directors of Sweetspot, the Sponsor, any companies affiliated with Sweetspot or the Sponsor, representatives, dealers and agents of Sweetspot or the Sponsor, Contest suppliers and any immediate family members (defined as parents, children, siblings and spouses, wherever they reside) and those with whom any of them are domiciled.

HOW TO ENTER
To be entered for a chance to win, visit the Contest landing page on the Site and submit the entry form, including a JOHNSON’S® Baby product UPC number. Alternatively, to enter by mail, clearly print your name, complete mailing address, daytime telephone number, email address and age at the time of entry on a plain piece of paper, along with a description of why you and your baby should receive a VIP Mommy & Baby Photo Shoot Experience (maximum of fifty (50) words) and submit it to the attention of Sweetspot.ca Inc. 60 Bloor St W, Suite 1005 Toronto, ON M4W 3B8.  Mail in entries must be postmarked no later than the Contest Closing Time and received by Friday, March 12, 2010.  Entries will not be eligible if submitted by any other method, which is not specified above, or if the entry is not received prior to the Closing Time. There is a limit of one (1) entry per person and/or email address regardless of the method of entry. Multiple entries of any kind will result in disqualification.

PRIZE
The Prize consists of a VIP Mommy & Baby Photo Shoot, including a professional photo shoot, a hair stylist and makeup artist, and lunch, to occur in the major city closest to the Winner's residence at the time of claiming the Prize.  The Winner will receive a portfolio containing ten (10) photographs following the shoot.  No substitutions except at Contest Sponsor’s option. The odds of winning the Prize for any contestant will depend on the number of eligible entries received during the Contest Period. Winner must be available to participate in the photo shoot on the dates and times designated by Sweetspot and the Sponsor. Should the Winner be unable to participate on such dates and times, the Prize will be forfeited and awarded to an alternate winner. Winner will be responsible for transportation to and from the photo shoot, and any other expense not explicitly included in the Prize.

DRAW
On Monday, March 15, 2010 at 9:00 a.m. EST, one (1) contestant will be chosen by random draw. The draw will be held in Toronto, Ontario and will be made from all eligible entries received during the Contest Period.

GENERAL
The selected contestant will be contacted by telephone or email on Monday, March 15, 2010  at 10:00 a.m. EST by a representative of Sweetspot at the telephone number or email provided in the contestant’s entry form.  If a selected contestant cannot be reached within five (5) business days, another contestant will be randomly selected. This procedure will be repeated until a selected contestant is reached. Neither Sweetspot, nor the Sponsor will be responsible for the failure, for any reason whatsoever, of a selected contestant to be reached.

Prior to receiving the Prize, the selected contestant must (a) correctly answer, unaided, a mathematical skill testing question, posed by telephone at a mutually convenient time; (b) show valid identification; and (c) sign a release and waiver: (i) granting to Sweetspot and the Sponsor the right to use the contestant's personal information (including name, mailing address, e-mail address, telephone number, city and province of residence, image and likeness (the "Personal Information")) for the purposes of administering the Contest, and the right to use the contestant’s name, city and province of residence, image and likeness for publicity related to the Contest, as further set out herein; (ii) releasing and holding harmless Sweetspot and the Sponsor, and their respective directors, officers, owners, partners, employees, agents, dealers, representatives, and affiliates  (collectively, the “Releasees”) of and from any and all liability arising out of use of the Personal Information, participation in the Contest, including the administration thereof, and the use or misuse of the Prize; (iii) confirming compliance with the Rules; and (iv) confirming acceptance of the Prize as offered. If a selected contestant is unable to meet these criteria, such selected contestant will be disqualified, and another entry will be randomly selected from the remaining eligible entries. The Prize will be distributed within three (3) months after the Winner has been successfully contacted and fulfilled the requirements set out herein.

In all matters relating to the promotion and awarding of the Prize, Sweetspot’s and the Sponsor’s rulings are final and without appeal. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy these Rules, may be disqualified by Sweetspot or the Sponsor. Sweetspot and the Sponsor take no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Neither Sweetspot nor the Sponsor is responsible for any errors or omissions in printing or advertising this Contest. All entries become property of Sweetspot and the Sponsor and will not be returned to the contestants. No communication or correspondence will be exchanged with contestants except with those contestant(s) selected for the Prize.

All Personal Information and other information requested by and supplied to Sweetspot and the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sweetspot and the Sponsor reserve the right, in their sole discretion, to disqualify any contestant who, at any stage, supplies untruthful, incomplete, inaccurate or misleading personal details and/or information.

By participating in this Contest, contestants grant Sweetspot and the Sponsor the right to use contestants’ Personal Information to administer the Contest, including contacting, promoting and announcing the Winner in any and all media, without further compensation unless prohibited by law. By opting-in online to receive relevant information and special offers from Johnson & Johnson companies in Canada, you consent to the Sponsor’s and any of its Canadian corporate affiliate’s use of your Personal Information to contact you about other offers and information from the Sponsor. By opting-in online to receive relevant information and special offers from Sweetspot, you consent to Sweetspot’s use of your Personal Information to contact you about offers and information from Sweetspot. Opting-in to receive such communications is not a condition of entry.  Sweetspot and the Sponsor will use contestants’ Personal Information only for the purposes identified herein, and will protect contestants’ Personal Information in a manner that is consistent with their respective privacy policies. Neither Sweetspot nor the Sponsor assumes responsibility for failure of the internet or the Site itself during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to a contestant's or any other person's computer related to or resulting from accessing any material on the Site. Sweetspot and the Sponsor are not responsible for any injury or damage to any contestant related to or resulting from participating in this Contest. Contestant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. Sweetspot and the Sponsor reserve the right, in their sole discretion, to cancel or suspend the Contest should a virus, bug or other cause beyond its reasonable control corrupt the security or proper administration of the Contest. By participating in the Contest , each contestant agrees to be bound by these Rules. Any attempt to deliberately damage the Site or to undermine the legitimate operation of this Contest is a violation of the Rules. Should any such attempt be made, Sweetspot and the Sponsor reserve the right to disqualify the contestant and/or seek remedies and damages to the fullest extent permitted by law, including and not limited to, criminal prosecution.

By entering the Contest, contestant releases and holds the Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prize or any other prize, participation in the Contest, any breach of the Rules, or in any Prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the Contest, without limitation.

If the identity of a contestant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the contestant. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A selected contestant may be required to provide proof that he or she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account that may be identified by reverse domain name search. The sole determinant of time for the purpose of receipt of a valid online entry in this Contest will be subject to the Contest server machines.

The Prize must be accepted as awarded, is non-transferable and is not convertible to cash. The Sponsor reserves the right to substitute the Prize or portion of the Prize with a prize of equal or greater value. Any unused portion of the Prize will be forfeited and have no cash value. The Winner is not entitled to the monetary difference between the actual Prize value and the stated approximate Prize value.

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by Sweetspot, the Sponsor and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

Subject to the jurisdiction of the Régie des alcohols, des courses et des jeux in Quebec, Sweetspot and the Sponsor reserve the right, in their sole discretion to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Rules in any way, at any time, for any reason without prior notice.

The Contest is subject to all applicable federal, provincial and local laws and regulations and is voidable where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between the contestant and Sweetspot or the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, the terms and conditions of the Rules shall prevail, govern and control. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Rules, the English language version shall prevail, govern and control.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcohols, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
